Information We Collect

We only collect information that is necessary to provide and improve our services to you. This includes:

Personal Information: When you create an account or use the App, we may ask for certain personal details. This specifically includes your email address, which is used for account registration, login, and customer support purposes. We do not require your name, physical address, or other contact details for using the App (except as needed for payment processing by the app stores, see Section 4).
User-Provided Content: The App allows you to input text-based prompts to generate images. These prompts (and the resulting images) are processed by our AI system. We may temporarily cache or store your prompts to facilitate the image generation and to improve the quality and accuracy of our service, but we do not use your prompts for any purpose other than providing you with the requested image and enhancing the App’s functionality.
Usage Data: When you use the App, we automatically collect certain technical and usage information. This may include:

Device Information: Such as your device model, operating system version, unique device identifiers, and device language settings.
Log and Interaction Data: Such as the features you use, the date and time of your requests, App performance metrics, and error/crash reports.
Approximate Location: We do not collect precise GPS location, but we might infer general location (e.g., country or region) from your IP address or device settings. This helps us understand where our user base is located (for example, to know language preferences or comply with regional legal requirements).

In-App Purchase Information: If you purchase Points or other paid features within the App, we will record the purchase details (such as the type and amount of Points purchased and the date of purchase). Please note: Payment processing (e.g., credit card information) is handled by the Google Play Store or Apple App Store. We do not receive or store your financial account details. We only receive confirmation of purchase and the amount of Points to credit to your account.

We do not intentionally collect any sensitive personal information (such as government ID numbers, health information, or biometric data). Please refrain from providing such sensitive data in the App.

How We Use Your Information

We use the collected information for the following purposes:

To Provide and Maintain the Service: We use your email to create and manage your account, authenticate your login, and provide you with access to the App’s features. Your text prompts are used by our AI system to generate the images you requested. Without this data, we cannot fulfill the core functionality of the App.
To Process Purchases: If you buy Points or other paid features, we use your information to facilitate the transaction (via the app store) and to update your in-app Points balance.
To Improve and Personalize the App: Usage data and analytics help us understand how users interact with the App. We analyze this data to fix bugs, optimize performance, and develop new features. For example, knowing which features are most popular or where users encounter errors helps us make the App better.
Communication: We may use your email address to send important account or service updates. For instance, we might send a verification email when you register, notifications about significant changes to the App or this policy, or respond to your customer support inquiries. We will not send you marketing or promotional emails unless you have explicitly opted in to receive them.
Security and Fraud Prevention: Information (like device identifiers and usage patterns) may be used to monitor for suspicious or fraudulent activity, enforce our Terms of Use, and protect the integrity and security of our services.
Legal Compliance: If we are under a legal obligation, we may process and disclose your data as necessary to comply with applicable laws, regulations, legal processes, or enforceable governmental requests (such as responding to a court order or law enforcement demand).

We will only process your personal data for the above purposes and in accordance with a valid legal basis (see Section 5 below). We do not use your personal information for automated decision-making or profiling in any way that produces legal or similarly significant effects on you.

Third-Party Analytics and Services

To better understand our App’s performance and how users interact with it, we utilize trusted third-party analytics services. Specifically, AIIG uses Google Analytics (a service provided by Google LLC) and Yandex AppMetrica (provided by Yandex LLC) for usage analytics and diagnostics.

What data is collected by these services: These analytics tools automatically collect data such as device information, usage frequency, screens viewed, features used, and crash reports. They may also collect coarse location data (e.g., region or country) and other technical information about your device’s interactions with the App. This data is primarily aggregated and does not directly identify you; it helps us observe trends and usage patterns. For example, we might learn how long an average session lasts, or how often a new feature is used.

How we use analytics data: The data collected through Google Analytics and Yandex AppMetrica is used strictly for improving our App’s functionality and user experience. It allows us to diagnose technical issues, analyze user engagement, and make informed decisions on feature development. For instance, if analytics show a feature is rarely used, we might investigate why and improve it. If a particular app version has many crashes on a certain device model, we can focus on fixing that.

Data sharing and privacy: These third-party services act as our service providers (or “processors”), meaning they process information on our behalf and under our instructions. They are contractually obligated to protect your data and not to use it for their own purposes. We do not receive personal details like your name or email through analytics, just the technical data mentioned. Both Google and Yandex maintain their own privacy policies explaining how they handle information: you can refer to Google’s Privacy Policy and Yandex’s Privacy Policy on their respective websites for more details. We ensure that our use of these services is compliant with GDPR, CCPA, and other relevant laws (for example, by enabling IP anonymization in Google Analytics where applicable).

Opt-Out options: Depending on your device, you may have options to limit data collection for analytics. For example, on Android or iOS, you can usually reset or limit the use of advertising identifiers, which our analytics may respect. At this time, our App does not have an in-app toggle to disable analytics, but you may contact us (see Section 11) if you have concerns about analytics, and we will provide guidance or manually honor legitimate opt-out requests for analytics to the extent feasible.

We do not use any advertising networks or social media plugins in the App that would collect your data for advertising purposes. Additionally, aside from the analytics mentioned and essential service providers, we do not share your personal data with any other third-party companies or services.

Legal Bases for Processing (GDPR Compliance)

If you are located in the European Economic Area (EEA) or United Kingdom, we rely on the following legal grounds under the GDPR to process your personal information:

Performance of a Contract: Most data processing is to fulfill our contract with you — for example, when you input a prompt and we generate an image, or when you purchase Points and we credit them to your account. We must process your data to provide the services you request as outlined in our Terms of Use.
Your Consent: We will rely on your consent where required. For instance, if in the future we wanted to send you optional marketing emails, we would first obtain your consent (and you can withdraw it at any time). Also, if required by law, we may ask for your consent before collecting certain analytics data or before processing personal data from minors.
Legitimate Interests: We may process your data for our legitimate business interests, such as improving and securing our App, communicating with you about product updates, or understanding how users engage with our App. When we rely on legitimate interests, we ensure that our interests are not overridden by your data protection rights – for example, we aggregate or anonymize data where feasible to protect your privacy.
Legal Obligation: In some cases, we have a legal obligation to process certain data. For example, we may need to retain transaction records for tax or accounting purposes, or disclose information to comply with a court order.

Sharing and Disclosure of Information

We treat your personal information with care and confidentiality. We do not sell your personal information to third parties. We also do not share your data with others except in the following circumstances:

Service Providers: We may share data with third-party companies that perform services on our behalf. This includes the analytics providers mentioned (Google and Yandex) and could include cloud hosting providers, email service providers (if we send emails), or customer support platforms. These service providers are given access only to the information necessary for them to perform their functions, and they are contractually required to protect it and use it only for our specified purposes.
Business Transfers: If the Company is involved in a merger, acquisition, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. If such a transfer occurs, we will ensure that your information remains subject to equivalent privacy protections and notify you (e.g., via email or a prominent notice in the App) of any change in data ownership or use.
Legal Compliance and Protection: We may disclose your information if required to do so by law or in a good-faith belief that such action is necessary to (a) comply with a legal obligation, such as a subpoena, court order, or regulatory request; (b) protect and defend our rights or property, or prevent fraud; (c) act in urgent circumstances to protect the personal safety of users or the public; or (d) enforce our Terms of Use or other agreements and policies.
With Your Consent: Apart from the cases above, if we ever need to share your information for any other purpose, we will inform you and obtain your consent (for example, if we partner with another company for a special feature and need to transfer data, we would ask for your approval).

Importantly, we do not sell or rent your personal data to any third parties for marketing or advertising purposes. In CCPA terms, we do not “sell” your data (as “sell” is defined by the CCPA). We also do not share your personal information for cross-context behavioral advertising without your consent.

International Data Transfers

AI Tech Solution is a team that may operate in or utilize servers and service providers located in multiple countries. When you use the App, your information (including personal data) may be transferred to and processed on servers outside of your country of residence. This can include servers in the United States, European Union, Russia (for Yandex’s systems), or other jurisdictions where our service providers maintain facilities.

If you are located in the EEA, UK, or another region with data protection laws, we will ensure that adequate safeguards are in place to protect your personal data during such transfers. These safeguards may include:

Standard Contractual Clauses: We may rely on standard data protection clauses approved by the European Commission, which legally bind recipients to protect your data according to EU standards.
Adequacy Decisions: Where applicable, we may transfer data to countries that are deemed to have an adequate level of data protection by regulators.
Other Measures: We may implement technical and organizational measures to secure data, such as encryption and access controls, and require that any foreign processors handle data in compliance with applicable laws.

By using the App, you acknowledge that your information may be transferred to facilities located in a different country and you consent to that transfer, storage, and processing. Regardless of where your data is processed, we will take appropriate steps to ensure it remains protected in line with this Privacy Policy.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, or as required by law. The exact duration may vary depending on the type of data and the context of its processing:

Account Information (Email, Profile): We keep your email and account data for as long as your account is active. If you choose to delete your account or request deletion, we will remove or anonymize your personal data within a reasonable time after fulfilling any outstanding obligations (for example, we may need to retain record of purchases for financial reporting). Backup copies of your data may persist for a short period in our backup systems, but will be deleted in the normal course of our backup rotation.
Prompts and Generated Content: Text prompts you provide may be stored transiently on our servers to process the image generation. In many cases, prompts and generated images are not stored long-term on our servers, and reside only on your device. If we do log some prompts or outputs (for example, to improve our AI model or to moderate content), we will either anonymize them (removing any account identifiers) or delete them after analysis. Any retained content logs will not be linked back to your personal information.
Analytics Data: Data collected via Google Analytics, Yandex AppMetrica, or similar tools may be retained by us indefinitely in aggregated form to help us with long-term performance trends. Raw analytics data (especially any that could be tied to user identifiers, such as device IDs or IP addresses) is typically retained for a shorter period (for instance, Google Analytics generally retains user-level data for 14 months by default, unless we configure otherwise). We follow recommended practices to not keep identifiable analytics data longer than necessary.
Communications: If you contact us (e.g., support emails), we may retain those communications for a period of time in order to manage your inquiry and improve our services. These records are generally kept for up to a couple of years unless a longer retention is required for legal purposes (such as evidence of customer service interactions).
Legal Requirements: In certain cases, we may need to retain data longer if required by law. For example, financial records of purchases may be kept for the duration required by tax and accounting regulations (which can be several years, depending on jurisdiction).

When we no longer have a legitimate need to retain your information, we will dispose of it securely. This may involve deleting it or anonymizing it so that it can no longer be associated with you.

Your Rights and Choices

We respect your rights to your personal data. Depending on your location and applicable law, you have the following rights regarding the information we hold about you:

Rights Under GDPR (for users in the EEA, UK, and similar jurisdictions):

Right to Access: You have the right to request a copy of the personal data we hold about you, as well as information on how we process it.
Right to Rectification: If any of your information is inaccurate or incomplete, you have the right to ask us to correct or update it. For example, if you change your email address, you can update it in the App or ask us to do so.
Right to Erasure: You can request that we delete your personal data. This is sometimes called the “right to be forgotten.” You may do this, for instance, if you no longer want to use the App. Keep in mind we might need to retain certain information as required by law or for legitimate business purposes (as noted in Section 8), but we will comply with deletion requests to the fullest extent possible.
Right to Restrict Processing: You have the right to ask us to limit processing of your data in certain circumstances – for example, if you contest the accuracy of your data, you can request we restrict processing until the accuracy is verified.
Right to Object: You may object to our processing of your data if you believe it infringes on your rights. For instance, you have the right to object to processing done on the basis of our legitimate interests. If you object, we will re-evaluate your request and will stop or adjust processing unless we have compelling legitimate grounds to continue (or if it’s needed for legal reasons). You can also object separately to any direct marketing (though we currently do not send marketing messages without consent).
Right to Data Portability: You can request a copy of the data you provided to us in a machine-readable format, and you have the right to transmit that data to another service (when technically feasible). For example, you could ask for an export of your account information.
Right to Withdraw Consent: If we are processing any of your data based on your consent, you have the right to withdraw that consent at any time. For example, if you gave consent for a future newsletter, you can opt-out later. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

Rights Under CCPA (for California residents):

Right to Know: You have the right to request that we disclose what personal information we collect, use, disclose, and sell (though note, we do not sell data). This includes the categories of personal information, the categories of sources, the business purpose for collection, the categories of third parties with whom we share it, and the specific pieces of personal information we hold about you.
Right to Delete: You can request that we delete any personal information about you that we have collected, subject to certain exceptions (for example, if the information is necessary to complete a transaction you requested, or to detect security incidents, etc.). As noted above, we will delete to the extent we can, while certain legal or operational retention needs may permit keeping some data.
Right to Opt-Out of Sale/Sharing: The CCPA gives consumers the right to opt out of the “sale” of personal information. We do not sell your personal information in exchange for money. We also do not share your information for targeted advertising without your consent. Therefore, there is no need for you to opt-out of data sales in our case, as we don’t perform such activities. If this practice ever changes, we will update this policy and provide a “Do Not Sell or Share My Personal Information” option.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we won’t deny you our services, charge you a different price, or provide a lesser quality of service just because you exercised your privacy rights. However, please note that if you request deletion of necessary data (like your account email), we may not be able to continue providing you the App’s full functionality (because, for example, we wouldn’t be able to authenticate you without an email).

Exercising Your Rights: You can typically exercise many of these rights directly within the App (for example, you can update your email, or delete your account in the settings if that feature is provided). For rights that cannot be managed through the App, or if you prefer, you may contact us at any time to exercise your rights. Please see the Contact Us section (Section 11) for how to reach us (usually via email). We may need to verify your identity before fulfilling certain requests (for instance, we might ask you to confirm from the email associated with your account or provide some identification information) to ensure that we do not disclose or delete data to the wrong person. We will respond to your request within the timeframe required by law (GDPR generally 1 month, CCPA generally 45 days, with possible extensions). There is no fee for making a request, though if requests become excessive or manifestly unfounded, we reserve the right to charge a reasonable fee or refuse to act on the request as permitted by law.

Children’s Privacy

We understand the importance of protecting children’s privacy. AIIG – AI Image Generator is not directed to children under 13, and we do not knowingly collect personal information from children under the age of 13. If you are under 13, please do not create an account or submit any personal data (including email address or prompts with personal information) through the App without parental consent.

We have not set a strict age requirement for using the App, meaning we do not outright prohibit minors from using it. However, if you are under the age of 18 (or under the age of majority in your jurisdiction), we strongly recommend that you use the App under the supervision of a parent or legal guardian. Some content generated by the AI might not be appropriate for very young audiences, and adult guidance is advised to ensure a safe and positive experience.

If we become aware that we have inadvertently collected personal information from a child under 13 (or under the applicable minimum age in certain jurisdictions) without parental consent, we will take steps to delete that information promptly. If you are a parent or guardian and you believe your child under 13 has provided personal data to us without your consent, please contact us (see Section 11) and we will delete the data and terminate the child’s account if applicable.

Data Security

We take the security of your information seriously. We implement technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to:

Encryption: We use encryption protocols (e.g., HTTPS/TLS) to secure data transmission between the App and our servers. This means that data like your login credentials and prompts are encrypted while in transit.
Access Controls: We limit access to personal data to authorized personnel who need it to operate, develop, or improve our App. Those who have access are subject to strict confidentiality obligations.
Security Testing and Updates: We regularly update our application and backend systems to address security vulnerabilities. We also use firewalls and monitoring to protect against malicious attacks.
Secure Storage: Personal data is stored on servers that have appropriate safeguards (such as secure data centers with controlled access). Passwords, if stored, are hashed and not stored in plain text.

Despite our efforts, please note that no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security. It is important for you as well to protect against unauthorized access to your account and personal data by keeping your login credentials confidential and ensuring you log out of the App when finished if you are on someone else’s device. In the event of a data breach that affects your personal information, we will notify you and the relevant authorities as required by law, and we will take immediate steps to mitigate any potential harm.
